Associazione Avvocatura per i diritti LGBTI (C-507/18)
Thaïs PAYAN, associate of the European Law department has just written a note on the Associazione Avvocatura per i diritti LGBTI judgment (C-507/18). On April 23rd, 2020, the European Court of Justice ruled that homophobic remarks made by a lawyer on a radio program constituted discrimination in matters of employment and work, as this lawyer has or may be perceived as having a decisive influence on the recruitment policy. The Court of Justice aims at extending the protection against discrimination in employment. It also grants locus standi to an association of lawyers whose purpose consists in defending people with a certain sexual orientation, irrespective of its profit purpose or of an injured party.
